A motorcyclist was seriously injured in August when an SUV struck his bike near the I-70 and I-635 interchange in Kansas City, Kansas, and then left the scene. Hit-and-run crashes leave riders facing medical bills, lost work, and an insurance claim with no identified driver. Kansas law does provide avenues for recovery.
What Troopers Reported
The crash happened just after noon on Monday, Aug. 17. According to the Kansas Highway Patrol, a 32-year-old Kansas City, Kansas, man riding a 2026 Yamaha passed a Hyundai SUV on I-70. The Hyundai then swerved to the right and struck the motorcycle.
The rider lost control. His bike hit the right guardrail and came to rest on the shoulder of the ramp to northbound I-635. He was wearing a helmet and was taken to the University of Kansas Hospital with serious injuries, WIBW reported.
Kansas Law Requires Drivers to Stop
Under K.S.A. 8-1602, a driver involved in a crash that injures someone must stop immediately and stay at the scene until meeting the state’s reporting and aid requirements. Leaving an injury crash is a class A person misdemeanor. The penalties increase with the severity of the injuries, and a fatal hit-and-run can be charged as a felony.
Criminal charges and a civil injury claim are separate. A prosecution punishes the driver. It doesn’t pay a rider’s hospital bills.
Coverage When the Driver Is Never Found
If investigators identify the SUV driver, the rider can pursue that driver’s liability insurance. Many hit-and-run vehicles are never located, however. In those cases, the rider’s own uninsured motorist coverage is usually the primary source of compensation.
Kansas requires uninsured motorist protection in auto policies under K.S.A. 40-284, and Kansas courts have applied that requirement to motorcycles. Some policies attach conditions to hit-and-run claims, such as corroboration from an independent witness. Evidence gathered early carries real weight.
Evidence Worth Preserving
Hit-and-run claims depend on details. Riders and families should try to keep:
- The Kansas Highway Patrol crash report and case number
- Names and phone numbers of witnesses who stopped
- Photos of the motorcycle, riding gear, and helmet
- Dashcam or business camera footage, which may be erased quickly
- Medical records starting with the first emergency visit
Report the crash to your insurer promptly. Many policies set notice deadlines.
Why Legal Guidance Matters for Riders
Insurers do not always treat injured motorcyclists fairly, even when the rider pays the premium. An adjuster may claim the rider was speeding or passed unsafely. A Kansas City motorcycle accident lawyer riders rely on can review the policy, obtain the full crash report, and answer those arguments with evidence.
Speaking with a Kansas City motorcycle accident lawyer before giving a recorded statement to any insurer can protect your claim.
